Supreme Court stays execution of Bagbin’s ruling declaring four seats vacant

The Supreme Court of Ghana has imposed a stay of execution on the verdict by Speaker of Parliament Alban Bagbin, declaring the seats of four Members of Parliament (MPs) vacant. This is a significant legal move.

Cynthia Morrison (Agona West), Kwadjo Asante (Suhum), Andrew Amoako Asiamah (Fomena), and Peter Kwakye Ackah (Amenfi Central) are among the impacted Members of Parliament.

In order to allow for additional legal examination, the court’s decision essentially stops the Speaker’s decision from being implemented.

The Speaker’s decision followed a motion submitted by former Minority Leader Haruna Iddrisu, who invoked constitutional provisions requiring Members of Parliament to resign their seats if they change their political membership or run as independent candidates.

In accordance with these clauses, Bagbin proclaimed the four seats vacant igniting debate and laying the groundwork for a court case.

It is anticipated that the Supreme Court’s stay order will postpone the ruling’s implementation and preserve the current makeup of Parliament until the case is resolved.
