AG files appeal at Supreme Court against acquittal of Jakpa and Ato Forson

The decision made by the Court of Appeal to exonerate and release Minority Leader Dr. Cassiel Ato Forson and Richard Jakpa in the ambulance procurement case has been challenged by the Office of the Attorney General.

In a Notice of Appeal dated August 8, 2024, the AG contended that the majority ruling was incorrect in interpreting the standard of proof required to decide whether to call the accused to answer to the allegations against them.

The appeal further contends that the majority’s finding that the letters of credit did not constitute a payment under the contract contradicts the evidence presented and is untenable.

The appeal also challenges the majority’s finding that the Ministry of Health was accountable for the monetary loss, contending that it was based on serious mistakes and that there had been a significant injustice.

The Attorney General is requesting that the Supreme Court reverse the accused’s discharge and acquittal and allow them to resume their defence.
