The Minority’s attempt to declare the seats of independent MPs void has prompted Majority Leader Alexander Afenyo-Markin to seek an injunction case at the Supreme Court.
Haruna Iddrisu, the former Minority Leader, announced plans to use Article 97(1)(g) of the Constitution to remove three Majority MPs and one NDC MP from office.
If a member of parliament decides to stay in Parliament as an independent candidate or leaves the party they were elected under, they are required to resign their seat, according to the article.
Haruna Iddrisu has already written to the Speaker, urging the declaration of these four parliamentary seats as vacant.
If the motion succeeds, the NDC, currently holding 137 seats, would become the Majority party, dramatically altering the balance of power in Parliament.
Presently, the House consists of 138 Majority MPs and 137 Minority MPs.
Mr. Afenyo-Markin stated that he was reluctant to go back and review the 2020 precedent, wherein the seat of NPP MP Andrew Amoako Asiamah was deemed vacant due to like circumstances.
He is adamant that the matter be decided by the Supreme Court.
The four MPs who are in danger of losing their seats after deciding to run as independent candidates in the next elections, according to constitutional attorney Justice Abdulai, have few legal options.
He emphasized that the constitutional provision is straightforward, leaving little room for interpretation.
